It’s fair to say, most nicotine pouch flavours and brands are accessible in Spain.

However, like so many countries, there are regulations which you need to be aware of and follow.

Labelling Rules

All nicotine pouch cans need to be labelled. The nicotine strength should be clearly marked. It’s generally between 1-20 mg/g, although there are stronger options available.

It’s worth noting that the tax on nicotine pouches, Spain is based on the amount of nicotine in the product.

Interestingly, the Spanish government demands that nicotine pouches have premarket authorisation. This ensures only approved products are for sale. However, at present, no pouches have been approved by the Spanish government.

That means, legal nicotine pouch sales in Spain are a grey area; Future regulations could easily make pouch availability more challenging.

Age Limits

Spain already has guidelines for purchasing any nicotine product. You must be over 18. It’s that simple.

Spain’s Proposed Regulations

“Concerningly, in early May 2025, the Spanish government submitted a draft proposal on future nicotine pouch regulations.”

The EU Commission has three months to review this draft.

The draft could be disastrous for the nicotine pouch industry and consumers. Why? Because it will mean that almost all nicotine pouches will no longer be legally sold in Spain.

The draft nicotine pouch regulations have already caused an issue. Sweden, Greece, Italy, the Czech Republic, and Hungary have all declared a formal opposition on the grounds that it will disrupt the free flow of goods across EU borders.

That’s a core principle of the EU single market.

The proposed regulations would include a nicotine limit of 0.99 mg per pouch. That’s significantly less than most countries and pouches on offer. They range from 1.5 mg to 20 mg (although they can go higher).

In addition, Spain proposes to eliminate all flavours other than tobacco. This may make the pouches less appealing to young people, but it will have the same effect on adults.

In other words, it will make it less appealing to switch from cigarettes to the nicotine pouch option which has fewer health risks than smoking.

Of course, you have a little time. The early objections to the Spanish draft regulations mean that the European Commission will extend the consultation by an extra three months.

During that time, Spain will be able to respond to these objections and try to convince the commission that they are unfounded.

A failure to respond will allow the commission to instigate further proceedings or cancel the draft.
